Ukraine: new norms of foodstuffs’ railway transportation are to be elaborated

Ukrainian Antimonopoly Committee has recommended to Ukrainian Health Ministry to bring actual sanitary norms and standards of foodstuffs’ railway transportation into conformity with ruling competition legislation, reported APK-Inform referring to Antimonopoly Committee’s press-service.
As to report, actual Ukrainian sanitary norms and standards oblige cargo owners to carry out disinfection of railway foodstuffs’ cars at their own cost; yet, detailed analysis of ruling transportation laws convincingly proves these requirements’ being in controversy to Law «About Assuring Population’s Sanitary and Epidemiological Security» as well as to Ukrainian Railway’s Statute, stipulating the railway cars’ disinfection to be carried out not by cargo owners, yet by railway cars’ owners.
Commenting on situation, Oleksiy Kostusiev, Antimonopoly Committee’s Chief, said: «Bodies of power are obligatory to accord with us drafts of all norm-setting acts which are possible to influence domestic competition. It’s one of control mechanisms, as stipulated by ruling legislation. In what concerns this case, however, Health Ministry didn’t do it.»
«Ukrainian Health Ministry is to have Committee’s recommendations fulfilled within 30 days, to accept proposed changes as well as to coordinate with Committee all new norms and standards of foodstuffs’ railway transportation,» added Antimonopoly Committee’s Chief.
«Otherwise we are to initiate arbitral proceedings,» stressed O. Kostusiev.
As to APK-Inform’s earlier reports, both Transport and Health Ministries had to
provide Committee with information as for their having fulfilled Committee’s recommendations on simplifying order of railway cars’ disinfection in course of grain transportation. On Nov 9 meeting Committee recommended shortening the list of transported goods which demand obligatory railway cars’ disinfection, suggesting goods being not foodstuffs (in particular tobacco, oilcake, grain etc) to be excluded from the list.
