Taiwan: Taiwan Requires New Dairy Certificates Effective May 1, 2020

Following are selected highlights from a report issued by a U. S. Department of Agriculture attache in The Taipei (Taiwan), Effective May 1, 2020, all U.S. dairy products for food purposes under HS Codes 0401, 0402, 0403, 0404, 0405 and 0406 must be accompanied with the USDA Agricultural Marketing Service (AMS) joint health certificate for import clearance. On April 26, 2018, the Taiwan Food and Drug Administration (TFDA) proposed an import certification requirement on egg products and dairy products. Dairy products under seven specific HS codes, 0401, 0402, 0403, 0404, 0405, and 0406, must be accompanied with official certificates that individually note that the products is for food purposes and in compliance with relevant food safety and sanitary regulations. The certificates must be issued by the competent authority of the exporting country. During the meeting of the 25th Session of the AIT-TECRO Sanitary, Phytosanitary and Agricultural Standards Working Group Consultations Food Safety Session in September 2018, it was agreed that the United States would provide, in writing, proposed certificates for dairy products by harmonized HS codes. USDA has actively worked with TFDA in providing proposed certificates in order to prevent future trade disruption. On November 9, 2018, TFDA confirmed that the proposed U.S dairy export certificate by USDA-AMSmet their requirements. On February 5, 2020, TFDA notified domestic industry and filed a notification through World Trade Organization under G/SPS/N/TPKM/519. The import of dairy products for food purpose shall be accompanied with official certificates. The requirements are as follows: 1.The import of dairy products for food purpose shall be accompanied by official certificates issued by the competent authority of the exporting country indicating that the attested products are suitable «for human consumption», or «in compliance with relevant food safety and sanitary regulations»; 2. The requirements apply to products of HS Codes are 0401, 0402, 0403, 0404, 0405 and 0406. *This implementation date of this requirement is on May 1, 2020. Effective May 1, 2020, all U.S. dairy products for food purpose under HS Codes 0401, 0402, 0403, 0404, 0405 and 0406 must be accompanied with the USDA-AMS joint health certificate for import clearance.
